USMCA: Are the Dispute Resolution Mechanisms Functioning as Intended?
Since its ratification in 2020, the United States-Mexico-Canada Agreement (USMCA) has played a central role in North American trade disagreements, settling two formal disputes on Canadian dairy tariffs in 2022 and U.S. regional content requirements for automobiles 2023. Impending disputes over Mexican energy policies and an announced ban on the import of GMO corn for human consumption, as well as a number of resolved and pending disputes under the labor chapter’s rapid response mechanism underscore the necessity for businesses, policymakers, and the public at large to understand the process for resolving disputes outlined in the Agreement.
